What happened

Maksat Duysenov is a former Chief Transport Prosecutor of Kazakhstan and a former officer of the country's Financial Police Agency, who held senior positions in the national enforcement system for many years. After a shift in the political climate he became the subject of criminal prosecution at home and was forced to leave Kazakhstan. In Germany he applied for political asylum. The Kazakh authorities placed him on the international wanted list and filed a formal extradition request seeking his return. Held in custody in Germany, he was in an acutely vulnerable position: the prospect of surrender was real, and the time available to build a position was short.

    A detailed submission was prepared for the German refugee authorities: biographical material, documentation of the systematic prosecution of former enforcement officers in Kazakhstan, and evidence of the political background to the case.

    ARGA built a full position against the Kazakh extradition request: objections were drafted, evidence of departures from fair-trial standards in the client's home country was assembled, and international human rights experts were brought in.

    ARGA Observatory produced an analytical report on the use of international alert mechanisms to pursue former officials in Kazakhstan. The material was submitted to the relevant human rights organizations.

    Germany refused the extradition. Maksat Duysenov was released from custody. The refusal took effect and is not subject to appeal.
